Terms & Conditions

Highland Adventure Safaris Ltd ("the Company") accepts your ("the Customer") booking under the following terms and conditions.

Public Booking Terms & Conditions

These Terms & Conditions apply to bookings made with Highland Safaris ("Highland Safaris", "we", "us" or "our"). By making a booking, you accept these Terms for yourself and anyone included in your booking.

1. Bookings and Payment

  1. 1.1 Bookings can be made online, by phone or in person.
  2. 1.2 Your booking is confirmed once we have received full payment.
  3. 1.3 Please check your booking confirmation carefully and contact us as soon as possible if anything is incorrect.

2. Prices

  1. 2.1 Prices are as shown at the time of booking unless there is an obvious error.
  2. 2.2 Prices include VAT where applicable.
  3. 2.3 Any optional extras will be charged at the price confirmed at the time of booking.

3. Customer Cancellations and Changes

  1. 3.1 If you need to cancel your booking, please let us know as soon as possible. Your cancellation will take effect when we receive your notice.
  2. 3.2 Unless different cancellation terms are stated and agreed at the time of booking, the following terms apply.

Bookings for up to 12 people

  1.  •    More than 5 days before the activity date: Full refund.
  2.  •    Less than 5 days before the activity date, but more than 48 hours before the activity start time: 50% refund.
  3.  •    Less than 48 hours before the activity start time: No refund.
  4.  •    No notice or failure to attend: No refund.

Bookings for more than 12 people

  1.  •    More than 28 days before the activity date: Full refund.
  2.  •    Between 14 and 28 days before the activity date: 50% refund.
  3.  •    Less than 14 days before the activity date: No refund.
  4.  •    No notice or failure to attend: No refund.
  1. 3.3 The applicable cancellation policy will be determined by the total number of people included in the booking when it is originally confirmed. Reducing a booking of more than 12 people to 12 people or fewer will not automatically change it to the smaller-group cancellation policy.
  2. 3.4 If fewer people attend than were booked, or you ask to reduce the number of people attending, we may treat the missing places as a partial cancellation. Any refund will be calculated using the cancellation policy applicable to the original booking.
  3. 3.5 Cancellation charges are intended to reflect the losses and costs we are likely to incur as a result of the cancellation. Where we are able to resell the cancelled places or otherwise reduce our loss, we may increase the refund amount accordingly.
  4. 3.6 We cannot usually offer refunds if you arrive late and miss all or part of the activity.
  5. 3.7 If you ask to move your booking to another date or time, we may agree to do so where availability allows. Any transfer is at our discretion and may be subject to an administration charge, any increase in price and the cancellation terms applicable to the original booking.
  6. 3.8 If you cannot attend because of illness, injury, travel disruption, adverse weather affecting your journey or other personal circumstances, the cancellation terms above will continue to apply unless we agree otherwise.

4. Changes or Cancellations by Highland Safaris

  1. 4.1 We will do our best to provide your activity as booked.
  2. 4.2 However, we may need to make reasonable changes to routes, timings, vehicles, activities or other arrangements because of weather, ground conditions, health and safety, animal welfare, staffing, access restrictions, mechanical issues, operational needs or events beyond our control.
  3. 4.3 Where possible, we will try to offer a suitable alternative, a revised time, or another date.
  4. 4.4 If we cancel your booking and cannot offer a suitable alternative, we will refund the amount paid for the affected booking.
  5. 4.5 We are not responsible for indirect or consequential costs, such as travel or accommodation booked with third parties, unless the law says otherwise.

5. Minimum Numbers

  1. 5.1 Most experiences require a minimum of 4 full-paying adults unless we say otherwise.
  2. 5.2 If minimum numbers are not reached, we may cancel the experience, offer an alternative date or time, offer an alternative experience, or provide a refund.
  3. 5.3 Private bookings or exclusive-use experiences have no minimum number of guests unless we tell you otherwise.
  4. 5.4 Private or exclusive-use bookings include, for example, Private Charter Safaris, exclusive-use Land Rover safaris, exclusive-use RIB safaris and private hire of the Red Deer Centre or other Highland Safaris facilities or experiences.

6. Participation and Safety

  1. 6.1 It is your responsibility to make sure the activity is suitable for you and everyone in your group.
  2. 6.2 Please tell us before booking, or as soon as possible afterwards, about any relevant medical condition, mobility issue, access requirement, allergy or other special requirement that may affect participation.
  3. 6.3 Some activities take place outdoors, on uneven ground, in rural locations and around vehicles, animals, water and other natural hazards.
  4. 6.4 You and everyone in your group must follow all reasonable instructions given by our staff.
  5. 6.5 We may refuse participation, remove a customer from an activity, or ask someone to leave if, in our reasonable opinion, they are intoxicated, impaired, behaving unsafely or inappropriately, failing to follow instructions, or creating a risk to themselves, others, animals or property.
  6. 6.6 No refund will be due where participation is refused or ended for these reasons.

7. Clothing and Weather

  4. 7.4 Safaris and activities will normally go ahead in any weather that we consider safe.
  5. 7.5 If you choose to cancel because of weather conditions but we are able to operate safely, our normal cancellation terms will apply.

8. Children, Dogs, Smoking, Alcohol and Behaviour

This includes, but is not limited to, harassment, intimidation or discriminatory behaviour such as racism, sexism, homophobia or other hate-related conduct towards our staff, customers or any other person. No refund will be due in these circumstances.

9. Liability

  1. 9. We take reasonable care in providing our activities and in protecting the health and safety of customers while on our premises or taking part in our activities.
  2. 9.2 Many of our activities take place in outdoor and rural environments and involve normal, obvious risks that cannot be removed entirely.
  3. 9.3 We are not responsible for loss of or damage to personal property, clothing, valuables, vehicles or other belongings brought onto our premises or taken on an activity, unless caused by our negligence or where the law says otherwise.
  4. 9.4 You are responsible for any loss, damage, cost or expense caused by you or anyone in your group to our property, vehicles, equipment, land, buildings, staff, animals or other customers.
  5. 9.5 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.

10. Events Beyond Our Control

  1. 10.1 We are not liable for delays, changes, cancellations or failure to perform any booking where this is caused by events beyond our reasonable control.
  2. 10.2 This may include severe weather, unsafe ground conditions, flooding, fire, power failure, road closures, access restrictions, government action, supplier failure, mechanical issues, industrial action, terrorism, war, civil unrest or similar events.
  3. 10.3 Where possible, we will try to offer an alternative date, revised arrangement or suitable substitute activity. If that is not possible, our liability will be limited to the amount paid for the affected booking.

11. Complaints

  1. 11.1 If you are unhappy with any part of your experience, please tell a member of staff as soon as possible so we have a fair opportunity to help.
  2. 11.2 If the issue is not resolved during your visit, please send your complaint in writing as soon as reasonably possible after your booking, including your booking reference and details of the issue.
